Contracting

A standard Groundwork contract - with a comprehensive creative brief and suitable appendices attached - will suffice in most situations. The danger lies in overlooking key aspects that may not spring to mind whilst discussing the creative aspects of the project - for example :

  • Preparatory site works
  • Who sources and pays for materials
  • Responsibility for getting permissions
  • Changes to design
  • Repairs and Maintenance
  • Product Liability
  • Public Liability Insurance
  • Copyright/Moral Rights/Ownership
  • Re-location of work at a future date
  • Decommissioning

Only a few of these might apply to any given project - but in some instances they could all apply. Make sure you work through these issues with the artist to determine responsibility for each, especially in relation to any costs that might be incurred. Make sure that a figure is set aside in the budgets for these items.

Remember to be upfront with artists about the procurement process – especially if it involves competitive tendering. Artists need to be confident that ideas and solutions they share with you will not subsequently end up in a brief that goes out to tender!
